Personal Injury Claims – Your right to fair compensation

Making a claim for compensation for personal injuries as a result of an accident has in recent years been tarred with negative expressions such as “compensation culture” and “ambulance chasing” in addition to publicity over scandals involving fraudulent claims.  

However, the reality is that if you are injured through no fault of your own, then you should be entitled to fair compensation for your injuries and any economic losses, and as such should seek advice from a solicitor at an early stage.  Most solicitors offer advice under a “no win no fee” agreement (formally known as a conditional fee agreement) should they be satisfied that the claim has good prospects of succeeding.  

Most claims worth under £25,000 are now submitted through a Claims Portal on the internet which then forwards details of the claim to the potential defendant’s insurance company who then has a period of time ranging between 15 and 40 business days to respond to your solicitor to advise whether or not they accept responsibility for the accident.  If they accept liability, your solicitor will attempt to settle the matter out of Court and will obtain medical evidence to establish the prognosis for your injuries and to determine a value for your compensation.  

If liability for the accident is denied through the Portal or a settlement for a fair amount cannot be achieved out of Court, your solicitor will advise you on whether or not you should start action through the County Court.  

Your solicitor will able to conduct the process on your behalf and advise you as to what level of compensation is appropriate for your injuries and financial losses.  

If you have suffered an injury through no fault of your own and indeed have found yourself out of pocket, then there is no reason why you should not seek redress.
